Virgin Galactic Wins Final Approval of $2.75 Million Derivative Settlement
Virgin Galactic disclosed that the U.S. District Court for the Eastern District of New York granted final approval on August 14 to a settlement resolving two consolidated shareholder derivative lawsuits. The company will receive a $2.75 million insurance-funded payment, retaining roughly half, with the remainder directed to plaintiffs' counsel.
The settlement is funded by insurance rather than the company's balance sheet, so the cash impact is modest in either direction. Its significance is procedural: it clears a governance-related legal overhang that had been outstanding while management works toward resuming commercial spaceflight operations.
Virgin Galactic remains a small speculative position in the Dyatome Capital portfolio, where the investment case rests on flight cadence and cash runway rather than litigation outcomes. Removing the derivative suits narrows the list of distractions but does not change the operational milestones the company still needs to hit.
